Tortious Interference

Tortious interference is a legal claim that can play an important role in enabling parties to fulfill their contractual obligations without interference from third parties. This claim can take two forms: interference with existing contracts and interference with prospective contracts or business relationships. In order to demonstrate interference with an existing contract, a plaintiff must establish the existence of a contract, intentional interference by a third party, and resulting damages. Importantly, the third party need not have intended to cause harm, but their actions must have resulted in injury.

What is tortious interference?

There are two types of tortious interference: tortious interference with existing contractual relations and tortious interference with prospective contractual or business relations. Both involve situations where one party intentionally undermines another party's business transactions or relationships. The primary difference is the existence of a contract.

How much will it cost to hire your firm to handle a tortious interference with a contract case?

There is no way to answer this question in a vacuum because the answer will depend on the facts and nature of the case. It is possible that GIW PLLC will agree to handle this type of case for a plaintiff on a contingency basis, which means it would not cost anything up front for GIW PLLC to handle this type of case because GIW PLLC would be paid a share of any recovery only in the event there is a recovery; if no recovery is obtained, no fees or reimbursable expenses incurred by the Firm would be owed. 

If however, GIW PLLC decides that the economics of the matter do not warrant handling the case on a contingency basis for a plaintiff wanting to bring tortious interference claims, or if the matter involves defending someone against claims of tortious interference, the client would be expected to pay GIW PLLC on an hourly basis at the hourly rate agreed on at the outset by the parties (in addition to reimbursement of any out of pocket expenses incurred by GIW PLLC in handling the representation).
